Terms & Conditions of Medical Practice

These Terms govern the use of the Breathe Ease website, digital appointment booking, teleconsultations, and related outpatient services provided in connection with Dr. Tarun Sharma.

Please read these Terms together with our Privacy Policy and any informed consent forms presented during your care. Acceptance of these Terms does not waive any statutory patient right, professional standard of care, or liability that cannot lawfully be excluded under Indian law.

1.Scope & Acceptance

These Terms apply to your use of drtarunsharma.com, online appointment booking, patient portal features, teleconsultation services, and related administrative workflows. Booking an appointment, creating an account, or accessing services constitutes acceptance of these terms.

Where a patient lacks capacity to contract independently (e.g. minors or incapacitated individuals), a parent, legal guardian, or authorized representative must hold lawful authority and accept these administrative terms on the patient's behalf.

2.Emergency & Urgent Care

DO NOT WAIT FOR THIS WEBSITE IN AN EMERGENCY

Severe breathlessness, acute respiratory failure, sudden chest pain, massive hemoptysis (coughing up blood), cyanosis (bluish skin/lips), loss of consciousness, anaphylaxis, or other life-threatening medical symptoms require immediate physical emergency evaluation.

Call 112 / 102 immediately or proceed to the nearest hospital emergency department. Do not rely on website messages, emails, digital messaging apps, or scheduled teleconsultations during medical emergencies.

Telemedicine is unsuitable for acute emergencies. If emergency indicators are identified during a remote consultation, the physician will immediately advise in-person emergency intervention and hospital referral.

Clinical services are provided strictly within the practitioner's lawful professional scope. The availability of online scheduling does not guarantee that a specific investigation, medication, procedure, or certification will be granted.

4.Doctor–Patient Relationship

A formal doctor–patient relationship is established only when Dr. Tarun Sharma accepts and conducts a clinical consultation or explicitly undertakes medical care.

Browsing this website, reading medical articles, submitting an inquiry, receiving automated notifications, or submitting an unconfirmed booking request does not, in itself, establish a doctor–patient relationship.

6.Telemedicine

  • Teleconsultations are conducted strictly in compliance with the Telemedicine Practice Guidelines issued under the National Medical Commission Act.
  • The physician reserves complete clinical discretion to determine whether remote evaluation is adequate or if an in-person physical examination, PFT, or hospitalization is required.
  • Remote care has intrinsic diagnostic limitations because physical palpation, auscultation, and immediate interventions cannot be conducted remotely.
  • Patients must join teleconsultations from a secure, quiet, and private environment and avoid driving or hazardous activities during the session.
  • Technical connection failures or poor audio-video quality may necessitate rescheduling or in-person evaluation.

7.Clinical Judgment & No Outcome Guarantee

Medical diagnoses and treatment plans are formulated based on clinical information reasonably available at the time of assessment. Changes in condition, emerging symptoms, or newly available diagnostic reports may require adjustments to the treatment plan.

No absolute guarantee of therapeutic cure, specific recovery duration, or symptom elimination is made or implied. This does not diminish the doctor's legal duty to exercise reasonable professional skill, care, and diligence.

Patients are always supported in obtaining a second opinion if they desire further clarification regarding their diagnosis or treatment.

8.Prescriptions & Medication Safety

  • Prescriptions are issued only when clinically warranted and legally permitted under Indian prescribing regulations and Telemedicine Practice Guidelines.
  • The doctor may decline to prescribe medications where remote clinical evaluation is inadequate, where in-person monitoring is required, or where restricted drug schedules apply.
  • Patients must take prescribed drugs exactly as directed and must not self-adjust, discontinue, or substitute medications without consulting the doctor.
  • Patients must immediately report suspected adverse drug reactions or clinical deterioration.
  • Prescriptions are strictly personal to the named patient; forging, modifying, duplicating, or transferring a prescription is illegal and subject to prosecution.

9.Appointments & Availability

  • Online booking requests become confirmed appointments only upon receipt of official confirmation from the clinic.
  • Doctor availability may change due to acute emergency cases, ICU duties, or unforeseen circumstances. In such events, the clinic will make reasonable efforts to notify and reschedule affected patients promptly.
  • A confirmed consultation slot covers the scheduled evaluation and does not imply continuous physician availability outside appointed hours.

10.Fees, Cancellation & Refunds

  • Professional consultation fees are clearly displayed before booking confirmation.
  • If the clinic cancels an appointment or a technical failure attributable to Breathe Ease prevents a teleconsultation, the fee will be rescheduled or refunded in full.
  • Once a consultation has been clinically performed, the professional service fee is non-refundable. Dissatisfaction with medical opinion does not entitle a patient to a refund, subject to statutory consumer protection rights.

11.Patient Responsibilities

  • Provide accurate, complete, and honest medical history and diagnostic reports.
  • Follow clinical instructions, take prescribed medications, and attend recommended follow-up tests.
  • Ask questions whenever treatment instructions or inhaler techniques are unclear.
  • Maintain custody and security of registered mobile phones, email accounts, and devices used to access medical records.
  • Refrain from tampering with medical records, prescriptions, or clinical notes.

12.Identity, Accounts & Fraud

Impersonating another patient or utilizing unauthorized identity documents, prescriptions, or payment credentials is strictly prohibited. The clinic reserves the right to suspend bookings or access where identity cannot be verified or fraud is suspected, while ensuring emergency care pathways remain accessible.

13.Messages & Response Times

  • Digital messaging channels (SMS, email, instant messaging) are intended for administrative scheduling and non-urgent clinical queries.
  • Messaging channels are not monitored continuously and do not guarantee an immediate response.
  • Where queries are too complex for messaging, the clinic may advise scheduling a formal consultation or visiting an emergency facility.

14.Recording, Screenshots & Privacy

To protect doctor-patient confidentiality and statutory privacy rights, recording, photographing, screenshotting, or publicly distributing audio-video teleconsultations without express mutual consent is prohibited, except where authorized by law or court proceedings.

15.Conduct & Safety

We maintain a zero-tolerance policy against violence, verbal abuse, harassment, intimidation, extortion, or discriminatory conduct directed toward Dr. Tarun Sharma, clinic staff, or fellow patients. Such behavior may result in immediate termination of non-emergency services and appropriate legal reporting.

This clause does not restrict any patient's right to submit honest feedback, register a genuine grievance, seek a second opinion, or exercise legal consumer remedies.

16.Third-Party Technology

Breathe Ease relies on reliable third-party infrastructure for hosting, database storage, authentication, messaging, and video streaming. While we select enterprise-grade partners, the clinic is not liable for independent telecommunication breakdowns, telecom carrier outages, or patient hardware failures beyond reasonable control.

17.Intellectual Property

Website design, educational articles, medical graphics, logos, and software belong to Breathe Ease and Dr. Tarun Sharma. Content may not be republished or commercially exploited without written permission. Patients retain full rights to copies of their own medical records and prescriptions.

18.Liability & Indemnity

To the maximum extent permitted by law, Breathe Ease is not liable for losses caused solely by circumstances outside reasonable control, including third-party internet outages, patient device compromise, or inaccurate medical history knowingly provided by the patient.

Nothing in these Terms excludes or limits liability for professional medical negligence, willful misconduct, or statutory duties that cannot lawfully be waived under Indian law.

19.Reviews, Complaints & Defamation

We welcome constructive feedback and provide structured grievance channels. Nothing here prevents patients from writing honest reviews or approaching statutory consumer and medical authorities.

However, coordinated fake review campaigns, extortion attempts, doxxing, or published fabrications intended to maliciously damage professional standing will be met with appropriate legal remedies under Indian law.

21.Governing Law & Disputes

These Terms are governed by the laws of India. Any legal dispute arising under these Terms shall be subject to the jurisdiction of competent courts in New Delhi, India, without affecting mandatory statutory consumer dispute forums.

22.General Legal Provisions

  • Severability: If any provision is deemed unenforceable, the remaining provisions remain in full force.
  • No Waiver: Delay in exercising a legal right does not constitute a waiver of that right.
  • Hierarchy: Statutory medical laws and specific informed consent forms supersede general website terms.
  • Electronic Record: This document constitutes an electronic record generated by a computer system in accordance with the Information Technology Act, 2000.
